Acceptable Use Policy

Super Sized Incorporated dba Literacy Path

1. PURPOSE

This Acceptable Use Policy (“AUP”) governs the use of the Literacy Path platform and all related products and services (the “Products”) by all users, including school districts, schools, educators, administrators, students, and any other authorized users (“Users”). This AUP is incorporated by reference into the Literacy Path Customer Terms and Conditions.

All Users must comply with this AUP. Violations may result in suspension or termination of access to the Products.

2. PERMITTED USE

The Products are designed for and may only be used for:

(a) Non-commercial, instructional purposes in K–12 educational settings;
(b) Student reading practice, assessment, and progress monitoring;
(c) Teacher and administrator access to student reports, dashboards, instructional materials, and classroom management features;
(d) Administrative purposes related to the management of classrooms, students, and educational programs; and
(e) Any other use expressly authorized in writing by Literacy Path.

3. PROHIBITED CONDUCT

Users shall not engage in any of the following activities:

3.1 Unauthorized Access and Security

(a) Access or attempt to access accounts, systems, or data not belonging to the User;
(b) Share login credentials, QR codes, or class codes with unauthorized individuals;
(c) Circumvent, disable, or interfere with any security features, access controls, or authentication mechanisms of the Products;
(d) Probe, scan, or test the vulnerability of the Products or any associated system or network;
(e) Introduce viruses, malware, ransomware, or other harmful code into the Products; or
(f) Attempt to gain unauthorized access to Literacy Path’s servers, systems, or networks.

3.2 Content and Intellectual Property

(a) Copy, reproduce, distribute, publish, or display any content from the Products, including but not limited to passages, questions, assessments, instructional materials, images, or videos, without prior written permission from Literacy Path;
(b) Modify, adapt, translate, or create derivative works based on the Products or any content therein;
(c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
(d) Use any content from the Products as input or training material for any machine learning, artificial intelligence, or large language model system;
(e) Use the Products or any content therein for any commercial purpose, including resale, redistribution, or licensing to third parties; or
(f) Screenshot, photograph, record, or otherwise capture assessment content for purposes of sharing, distributing, or publishing.

3.3 Misuse and Abuse

(a) Use the Products for any purpose other than the educational purposes described in Section 2;
(b) Use the Products in any manner that violates any applicable federal, state, or local law or regulation;
(c) Harass, threaten, bully, intimidate, or harm any other User through the Products;
(d) Impersonate any person or entity, or misrepresent any affiliation with any person or entity;
(e) Interfere with or disrupt the Products or the servers or networks used to provide the Products;
(f) Use the Products to collect, store, or transmit personal information about other Users except as authorized by this Agreement and applicable law;
(g) Use automated systems, bots, scrapers, or similar tools to access or interact with the Products without prior written authorization from Literacy Path; or
(h) Use the Products in any manner that could damage, disable, overburden, or impair the Products or interfere with any other User’s use of the Products.

3.4 Student Data

(a) Access Student Data for any purpose other than the educational purposes for which the data was collected;
(b) Share, disclose, or transmit Student Data to any unauthorized third party;
(c) Use Student Data for marketing, advertising, or any non-educational commercial purpose; or
(d) Retain Student Data beyond the period necessary for the authorized educational purpose.

4. EDUCATOR AND ADMINISTRATOR RESPONSIBILITIES

Educators and administrators are responsible for:

(a) Supervising student use of the Products in a manner appropriate to the educational setting;
(b) Ensuring that student accounts are used only by the authorized student;
(c) Reporting any suspected misuse, security incidents, or AUP violations to Literacy Path promptly;
(d) Maintaining the confidentiality of class codes, login cards, and QR codes; and
(e) Using Student Data accessed through the Products solely for legitimate educational purposes.

5. STUDENT RESPONSIBILITIES

Students are responsible for:

(a) Using the Products only for educational purposes as directed by their teacher or school;
(b) Keeping their login information private and not sharing it with other students;
(c) Not attempting to access another student’s account or data;
(d) Treating all content in the Products respectfully; and
(e) Reporting any problems or concerns to their teacher.

6. MONITORING AND ENFORCEMENT

Literacy Path reserves the right to:

(a) Monitor use of the Products to ensure compliance with this AUP;
(b) Investigate any suspected violation of this AUP;
(c) Suspend or terminate access to the Products for any User who violates this AUP, with notice to the Customer;
(d) Remove or disable access to any content that violates this AUP; and
(e) Report any activity that Literacy Path reasonably believes violates any law or regulation to the appropriate authorities.

Literacy Path will notify the Customer prior to taking enforcement action against any Authorized School User, except where immediate action is necessary to protect the security or integrity of the Products.

7. REPORTING VIOLATIONS

8. CHANGES TO THIS POLICY

Literacy Path may update this AUP from time to time. If we make material changes, we will notify Customers by email or through the Products at least thirty (30) days prior to the changes taking effect. Continued use of the Products after the effective date of any changes constitutes acceptance of the updated AUP.
